These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MissAlert Technologies Private Limited ("MissAlert," "we," "us," or "our"), governing your access to and use of our website (scanitup.com), mobile application, physical products, and all related services (collectively, the "Platform").
By accessing the Platform, creating an account, making a purchase, or using any MissAlert service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease use of the Platform.
You must be at least 18 years of age to use MissAlert services. If you are using the Platform on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
MissAlert provides the following services:
We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time with or without prior notice, and we shall not be liable for any such modification or discontinuation.
You must provide accurate, complete, and current information when creating a MissAlert account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to immediately notify us at security@scanitup.com if you suspect any unauthorized use of your account. MissAlert will not be liable for any loss arising from your failure to protect your account credentials.
Each individual may maintain only one affiliate or user account. Creating multiple accounts to circumvent restrictions or gain additional benefits is prohibited and may result in immediate termination of all associated accounts.
All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless otherwise stated. MissAlert reserves the right to change product prices at any time without prior notice.
Orders are confirmed via email upon receipt of payment. We aim to dispatch physical products within 24–48 business hours. Delivery typically takes 3–7 business days depending on your location within India.
Unopened physical products may be returned within 30 days of delivery for a full refund. Activated or used tags are not eligible for return unless they are found to be defective. Digital services and app subscriptions are non-refundable after activation. To initiate a return, contact returns@scanitup.com with your order ID.
MissAlert QR tags are warranted against manufacturing defects for 12 months from the date of purchase. This warranty does not cover damage caused by improper installation, physical impact, or deliberate tampering.
By activating and using a MissAlert QR tag, you agree to the following:
The MissAlert Affiliate Program is open to Indian residents aged 18 and above who have a valid bank account or UPI ID for commission receipt. Employees, directors, and immediate family members of MissAlert are not eligible.
Commissions are calculated as a percentage of the net order value (excluding taxes and shipping) of qualifying sales attributed to your referral link within the 30-day cookie window. Commission rates are as published on our Affiliate Program page and are subject to change with 30 days' notice.
Affiliates must not engage in: paid search advertising using MissAlert brand terms, cookie stuffing or fraudulent click generation, spam email campaigns, misleading or false claims about MissAlert products, self-referrals (purchasing through your own affiliate link), or incentivised clicks without clear disclosure. Violations will result in immediate account termination and forfeiture of unpaid commissions.
Commissions are paid monthly on the 5th of each month for sales confirmed in the previous calendar month. The minimum payout threshold is ₹500. Commissions on orders that are subsequently cancelled or refunded will be reversed. MissAlert is not liable for any payment delays caused by incorrect bank or UPI details provided by the affiliate.
MissAlert reserves the right to modify commission rates, cookie windows, or programme terms at any time. Material changes will be communicated to registered affiliates with at least 30 days' notice via email.
All content on the MissAlert Platform, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the MissAlert brand name and logo, are the exclusive property of MissAlert Technologies Private Limited and are protected under Indian copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission. Affiliates are granted a limited, non-exclusive, revocable licence to use MissAlert brand assets solely for the purpose of promoting the affiliate programme in accordance with our brand guidelines.
You agree not to use the Platform to:
The MissAlert Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components. MissAlert does not guarantee that alerts will be delivered in all circumstances, including situations involving poor network connectivity, device restrictions, or app configuration issues.
To the maximum extent permitted by applicable Indian law, MissAlert and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, vehicle damage, or data loss, arising from your use of or inability to use the Platform. Our total aggregate liability for any claim arising out of or related to these Terms shall not exceed the amount you paid to MissAlert in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless MissAlert and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or related to these Terms shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bangalore, Karnataka. The language of arbitration shall be English. Courts in Bangalore, Karnataka shall have exclusive jurisdiction for matters not subject to arbitration.
MissAlert reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause and with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to the Platform or other users. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.
